By using this website or submitting a form on it, you agree to the following terms. If you do not agree, please do not use the site or submit information through it.
1. What this website is
This site provides general information about the appraisal and valuation services offered by Miner Appraisals, along with articles, calculators, and reference material. It is a marketing and information resource.
2. Nothing on this site is an appraisal
Content on this site, including any calculator, estimator, market commentary, article, or response to a form submission, is general information only. It is not an appraisal, not a valuation opinion, not a certification of value, and not legal, tax, accounting, or investment advice. Calculator outputs are rough estimates generated from inputs you supply, are unverified, and should not be relied on for any decision, including tax reporting, litigation, settlement, or lending.
An appraisal is only the written, signed report we deliver under a separate written engagement.
3. Submitting a form does not hire us
Requesting a quote or contacting us does not create a client relationship and does not obligate either of us to anything. We begin work only after a written engagement agreement is signed and any required retainer is received. Until then, no assignment exists, no deadline is committed, and no fee is owed. Any fee or turnaround estimate we provide is based on the information you supply and may change.
We do not accept assignments that are contingent on reporting a predetermined value, a direction in value, or the attainment of a stipulated result.
4. Intended use and intended users
Every appraisal we perform is prepared for a specific client, for a specific intended use, and for the intended users identified in the report. It is not intended for any other use or by any other party.
Anyone who is not an identified intended user of a report has no right to rely on it, regardless of how they obtained a copy. Possession of a report does not create an intended user, a duty of care, or any professional relationship with you. Use of a report for a purpose other than the stated intended use is unauthorized.
5. Information you provide
You agree that information you submit about a property, its condition, its history, or its ownership is accurate to the best of your knowledge. We may rely on it. Any opinion, quote, fee estimate, or turnaround time we give in response is based on that information and may change if the facts differ.
6. Site content is provided as is
We work to keep the site accurate and current, but we do not warrant that it is complete, error free, or continuously available. Market data, statutory references, and turnaround times change. We may modify or remove content at any time without notice.
7. Limitation of liability
To the fullest extent permitted by Utah law, Miner Appraisals and its owner, employees, and contractors are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost opportunity, or lost transaction value, arising out of your use of this website or your reliance on any information obtained from it.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to your use of this website is limited to one hundred dollars ($100.00). Liability arising out of a paid appraisal assignment is governed by the written engagement agreement for that assignment, not by these terms.
Nothing in these terms limits liability for fraud, willful misconduct, or any liability that cannot be limited or excluded under applicable law.
8. Third party links
The site links to third party sites and services that we do not control. We are not responsible for their content, accuracy, or practices.
9. Intellectual property
All content on this site, including text, photographs, graphics, floor plans, sketches, calculators, and reports, is owned by Miner Appraisals or its licensors and is protected by copyright. Appraisal reports we deliver are licensed to the client for the stated intended use only. Reports and their contents may not be reproduced, excerpted, distributed, or published, in whole or in part, without our prior written consent, except as required by law or as permitted in the engagement agreement.
10. Privacy
Information you submit is handled as described in our Privacy Policy, which is incorporated into these terms by reference.
11. Electronic records and communications
You consent to receive communications, agreements, notices, and records from us electronically, and you agree that your electronic acceptance, including checking a box on a form on this site, has the same effect as a handwritten signature for the purposes of these terms.
12. Governing law and venue
These terms are governed by the laws of the State of Utah, without regard to its conflict of laws rules. Any dispute arising out of or relating to these terms or your use of this site shall be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to the jurisdiction of those courts.
13. Changes to these terms
We may update these terms. The version number and effective date at the top of this page will change, and prior versions remain available. Continued use of the site after a change means you accept the current version. The version you agreed to at the time of a submission is the version that governs that submission.
14. Severability
If any provision of these terms is found unenforceable, the rest remains in effect.
